Acceptable Use Policy

1. Purpose and Scope

This Acceptable Use Policy ("AUP") governs the content, products, services, and activities that Creators may offer through the Onflay platform ("Platform") and the conduct expected of all users, including Creators and Customers.

This AUP is incorporated into and forms part of the Onflay Terms and Conditions. Capitalized terms used but not defined in this AUP have the meanings given to them in the Terms and Conditions. In the event of a conflict between this AUP and the Terms and Conditions on matters of permitted and prohibited content, this AUP controls.

By using the Platform, you agree to comply with this AUP. Onflay may update this AUP at any time by posting a revised version. Continued use of the Platform after the effective date of any revision constitutes acceptance of the updated AUP.


2. Prohibited Content Categories

The following categories of content, products, and services are prohibited on the Platform regardless of applicable local legality, unless Onflay has provided express written authorization for a specific Creator under Section 6:

2.1 Illegal and Harmful Goods and Services

  • Goods, services, or activities that are illegal under applicable local, national, or international law.
  • Products or services that facilitate, promote, or assist in the commission of a crime.
  • Products regulated as controlled substances, narcotics, prescription medications, drug paraphernalia, or materials used in the synthesis of controlled substances.
  • Goods that are counterfeit, stolen, or that misrepresent their origin, authenticity, or licensing status.
  • Products that violate export controls, trade sanctions, or import restrictions of any jurisdiction.

2.2 Weapons and Dangerous Items

  • Firearms, firearm components, ammunition, or accessories that facilitate lethal force.
  • Explosive devices, incendiary materials, or instructions for creating such items.
  • Weapons restricted under applicable law, including switchblades, brass knuckles, and prohibited modifications.
  • Products designed to cause bodily harm, even if legal in some jurisdictions.

2.3 Adult and Sexually Explicit Content

  • Adult, sexually explicit, pornographic, or obscene content of any kind, unless Onflay has granted express written authorization under Section 6.
  • Content that sexualizes or exploits minors in any form. This prohibition is absolute and admits no exception.
  • Content involving non-consensual sexual activity or that facilitates or glorifies sexual violence.

2.4 Financial and Professional Services

  • Unlicensed financial services, investment products, securities offerings, or financial advice in jurisdictions where such services require licensure.
  • Cryptocurrency, digital asset, or token offerings that are not compliant with applicable securities, commodities, and financial regulations.
  • Products or services constituting unauthorized legal, medical, psychiatric, or other professional advice in a regulated jurisdiction, including unlicensed therapy, legal services, or medical diagnosis.
  • Gambling, lotteries, sweepstakes, or games of chance, including online wagering platforms, unless specifically authorized in writing by Onflay. In the Dominican Republic, gambling activities are regulated under Ley 139-11; no gambling-related services are permitted on the Platform without Onflay's express written authorization and confirmation of applicable local licensure.
  • Multi-level marketing, pyramid schemes, or investment programs whose returns are dependent primarily on recruitment of other participants.

2.5 Deceptive and Fraudulent Practices

  • Products or services whose descriptions, pricing, images, or claims are false, misleading, deceptive, or likely to mislead a reasonable consumer.
  • Get-rich-quick schemes, guaranteed-return investment solicitations, or products marketed through false scarcity or urgency.
  • Fake reviews, testimonials, social media engagement, or other inauthentic social proof services.
  • Phishing kits, credential-harvesting tools, or services designed to deceive users into disclosing personal information.

2.6 Intellectual Property Violations

  • Products or services that infringe, misappropriate, or otherwise violate the intellectual property rights of any third party, including copyright, trademark, patent, or trade secret rights.
  • Unauthorized resale or distribution of software, media, or digital content without a valid license from the rights holder.
  • Content that circumvents technological protection measures or digital rights management systems.

2.7 Hate, Violence, and Harassment

  • Content that promotes, glorifies, or incites violence against any person or group.
  • Content that constitutes hate speech, defined as material that dehumanizes, threatens, or calls for discrimination against individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics.
  • Content that facilitates or encourages harassment, cyberbullying, stalking, or intimidation of any individual.
  • Content that targets minors for exploitation, grooming, or harm of any kind.

2.8 Privacy and Surveillance

  • Software, services, or tools designed for covert surveillance of individuals without their knowledge or consent, including stalkerware, hidden tracking applications, and unauthorized data-collection tools.
  • Personal data, contact lists, or databases obtained without proper authorization or consent.
  • Doxxing services, tools to reveal personal identifying information about individuals without their consent.

2.9 Platform Integrity

  • Tools, scripts, or services designed to manipulate Onflay's systems, pricing, or fee calculations.
  • Fee-circumvention schemes or attempts to route transactions outside the Platform to avoid applicable Platform Fees.
  • Impersonation of any Creator, Customer, Onflay employee, or third-party brand.
  • Fake listings, placeholder products, or listings not representing a genuine product or service offered by the Creator.

2.10 Sanctions and Restricted Parties

  • Products, services, or transactions involving parties listed on government sanctions lists, including the U.S. Treasury Office of Foreign Assets Control (OFAC) Specially Designated Nationals List, EU restrictive measures lists, the Dominican Republic Superintendencia de Bancos prohibited-party registry, Mexico's UIF (Unidad de Inteligencia Financiera) lists, or equivalent international and LATAM regulatory regimes.
  • Transactions involving jurisdictions subject to comprehensive sanctions.

3. Prohibited Conduct

In addition to the prohibited content categories above, the following conduct is prohibited for all Platform users:

  • Circumventing enforcement. Creating new accounts or using third-party accounts to access the Platform after a suspension or termination.
  • Misrepresentation. Providing false or misleading information to Onflay, Stripe, Wise, or any other party in connection with account registration, Creator screening, or compliance reviews.
  • Coordinated inauthentic activity. Coordinating with others to manipulate the Platform's systems, reviews, rankings, or dispute outcomes.
  • Automated abuse. Using bots, scrapers, or automated tools to access, harvest, or interact with the Platform except as expressly permitted in writing by Onflay.
  • Interference. Attempting to interfere with or disrupt the Platform's infrastructure, security measures, or other users' access.
  • Chargeback abuse. Filing payment disputes or chargebacks in bad faith, including for products or services received in accordance with the Listing description.

4. Enforcement

Onflay may investigate suspected violations of this AUP at any time. Upon determining, in its sole discretion, that a violation has occurred or is likely to occur, Onflay may take any or all of the following actions without prior notice:

  • Remove or delist any non-compliant Listing.
  • Issue a warning to the Creator or user.
  • Temporarily restrict access to Platform features.
  • Suspend or terminate the Creator's or user's account.
  • Withhold or freeze Payouts pending investigation.
  • Report the violation to law enforcement, regulatory authorities, or affected third parties.
  • Pursue civil remedies for losses caused by the violation.

The fact that a product or activity is not explicitly mentioned in this AUP does not mean it is permitted. Onflay retains the right to remove any content and take any enforcement action it determines to be appropriate in its sole discretion.

Enforcement actions under this AUP do not constitute a finding of legal liability. Onflay's decision to take or not take action with respect to a particular violation does not waive its right to take action with respect to similar or other violations.


5. Reporting Violations

If you believe a Listing or user conduct violates this AUP, you may report it to Onflay at:

Please include: the Listing URL or Creator identifier; the nature of the alleged violation; and any supporting evidence. Onflay will review reports in good faith but is not obligated to act on every report or to disclose the outcome of any investigation.


6. Exception Requests

Onflay may, in its sole discretion, grant written exceptions to certain categories in Section 2 (e.g., adult content for specific authorized Creators). Exception requests will be evaluated on a case-by-case basis.

To request an exception, contact legal@onflay.com with a detailed description of the proposed content, the applicable prohibited category, and the basis for the requested exception. Onflay is under no obligation to grant any exception. Granted exceptions are revocable at any time and do not constitute a general waiver of this AUP.


7. Relationship to Stripe Policies

Onflay's payment processing depends on Stripe, Inc. Stripe independently maintains a list of restricted and prohibited businesses and activities. Creators must comply with Stripe's restricted business policies in addition to this AUP. In the event of a conflict between this AUP and Stripe's requirements, the stricter requirement applies. Onflay's granting of an exception under Section 6 does not constitute authorization from Stripe.


8. Changes to This Policy

Onflay may update this AUP at any time. Changes will be posted to this page with an updated effective date. Material changes will be communicated to registered users by email or through the Platform. Continued use of the Platform after the effective date of any revision constitutes acceptance of the updated AUP.
